Abstract
This jurnal examines the application of Constitutional Court Decisions No. 18/PUU-XVII/2019 and No. 2/PUU-XIX/2021 regarding the judicial review of Law No. 42 of 1999 concerning Fiduciary Guarantees. These rulings have established a new paradigm for the enforcement of fiduciary guarantees—specifically regarding the determination of default and the execution of *parate executie* (summary execution)—practices that were previously carried out unilaterally by creditors. Such changes potentially affect the certainty and effectiveness of debt recovery in industrial financing and could lead to an increase in non-performing loan ratios if the enforcement process becomes protracted and reliant on court-based mechanisms.
